Preliminary project for comparison between Peruvian and Spanish law

I. PROBLEM

1. Idea, theme and title

1.1. Idea

Many Peruvian comparatists consider that all comparative law is limited to the study of civil law, that is, they confuse the first of those indicated with comparative civil law, with which we do not agree, because the latter is only one of the branches of comparative law, and other branches are comparative private law, public comparative law, mixed comparative law, comparative business law, comparative corporate law, among many others.

Peruvian law will be compared with Spanish law.

Comparison between Peruvian and Spanish law.

2. Formulation of the problem

Comparatists do not have specialized books on the comparison of Peruvian law with Spanish law, which makes it difficult for the corresponding legal receptions, circulation, migration and transplants, among the indicated rights, but we must recognize that the second of the indicated ones, as part of the law European, it has more development than Peruvian law, however, we hope that the thesis to be drafted serves to demonstrate that Peruvian law has been influenced by Spanish law, and therefore, they have many similarities, and both are part of the Roman legal family Germanic, known to others as the legal family of civil law, which is almost always opposed to the Anglo-Saxon or common law family.

3. Research objectives

The objectives of the present investigation are the following:

1) Know the differences and similarities between Peruvian and Spanish law.

2) Show that there are some similarities between Peruvian and Spanish law.

3) Show that there is little background in Peruvian law on the subject studied.

4) Publish on the topic studied.

4. Justification

The present investigation is justified for the following reasons:

1) The study of the future thesis is neglected within comparative law.

2) Many lawyers do not know about the macro comparison.

3) It is necessary to know the international legal macro comparison.

4) Every Peruvian comparatist must master the comparison between Peruvian and foreign law.

5) Many are unaware that comparative law between legal systems on different continents.

5. Limitations

The great limitations of this research work have been mainly the following:

1) Have completed few studies in comparative law.

2) Have few books on Spanish law in the Peruvian Republic.

3) Lack in the Peruvian state of libraries specialized in Spanish law.

4) The investigations of Spanish law that reach the Peruvian state are scarce.

5) There are few professors who master Spanish law and worse still the differences and similarities with Peruvian law.

II. THEORETICAL FRAMEWORK

6. State of the art

Currently the subject studied is quite neglected within Peruvian and Spanish law, which generates a series of problems for comparatists, because they lack books on the subject in question, and this prevents them from investigating in the most adequate way about the referred subject.

7. Theoretical foundations

Comparative law is not limited to the simple comparison of civil law in force with the repealed, but goes further, and it is an opportunity to clarify that the comparison can be applied to any source of law, any branch of it, any legal system, and to any legal family.

III. HYPOTHESIS

8. Elaboration of hypotheses

The hypotheses of the present project are the following:

1) The greater the spread of Spanish law in the Peruvian state, it is likely that there is a better understanding of its similarities and differences.

2) The greater the number of publications on the indicated topic, it is very likely that there will be fewer problems for legislators and legal operators, among others.

3) The more studies on the subject in question, it is likely that the study and application of comparative law among the studied legal systems will be easier.

4) A greater number of chairs of Spanish law is likely to be easier to teach.

9. Operationalization of variables

9.1. First hypothesis

Independent variable:

Greater dissemination of Spanish law in the Peruvian state

Dependent variable:

Better understanding of their similarities and differences.

9.2. Second hypothesis

Independent variable:

Greater number of publications on the indicated topic.

Dependent variable:

Fewer problems for legislators, and legal operators, among others.

9.3. Third hypothesis

Independent variable:

Further studies of the subject in question.

Dependent variable:

The study and application of comparative law between the studied legal systems is easier.

9.4. Fourth hypothesis

Independent variable:

Greater number of chairs of Spanish law.

Dependent variable:

Your teaching will be easier.

IV. METHODOLOGY

10. Design of information gathering techniques

For the collection of information, files will be used, but not on paper, but on electronic support, resorting to computer programs specially designed for this task. In addition, when appropriate, footnotes or footnotes will be used, which will make it easy to exercise the right of appointment, because copyright must be respected.

11. Determine population and sample

It is not developed because this item is only for applied research and the one we intend to carry out is dogmatic.

The research budget will be as follows:

4) Plaster: 20 fillings, two hundred nuevos soles.
