First, let's define what antichresis is: Antichresis is a contract by which a root item is delivered to the creditor to be paid with its fruits. The antichresis does not produce, effect, if not recorded by public deed. An antichretic creditor does not acquire real rights over the thing.
The antichristic administration occurs when the real estate is given to the antichretic creditor, who enjoys the same rights as the lessee for the payment of the improvements, damages and expenses; and it is subject to the same obligations relative to the conservation of the root thing.
It should be remembered that the creditor does not become the owner of the property for the sole lack of payment; nor will they have preference in it over the other creditors, but rather the one conferred by the mortgage contract. In addition, the debtor may not request the restitution of the real property until after the total extinction of the debt, but the creditor may restore it at any time and pursue the payment of his credit by other legal means, without prejudice to what is otherwise stipulated.
