It is very common that most people today do not measure the consequences of our actions when carrying out any activity, putting at risk our morale and that of others. Despite doing so consciously and unconsciously, thus causing a violation of labor human rights for the simple fact of trying to discriminate against our coworkers without taking into account that we can seriously affect them.

INTRODUCTION

Currently speaking about human rights is a topic that is not common among society, since despite the existence of institutions and organizations in charge of publicizing these rights, there is very little interest on the part of people. This is really worrying because when they are not known they become violated causing very big problems that can affect the individual morally and ethically.

Let's see then, in this essay I will focus exclusively on labor human rights, that is, those rights that belong to the workers of a company or institution. It must be emphasized that although they should be known by everyone who has a job, on many occasions the bosses or those in charge of reporting do not get to do it, this for their own benefit.

It is here where we will enter with the concept of "Moral Risk" since it influences in a very great way, because depending on the moral risk of each person, their labor rights may or may not be respected.

WHAT IS MORAL RISK?

Contemporary philosophy describes it as "When the subject does not have to pay the consequences of his acts, he will act differently from a subject who has the obligation to do so". We can interpret this when a person does not act in a conscious way and dissociates herself from the obligation to repair damages or consequences of her acts.

People who make incorrect decisions or behaviors in inappropriate states, due to the effects of harmful substances, negative emotions and bad feelings.

To make this clearer, I will mention an example from everyday life that, even if it seems like it, is not normal: When a person has hatred or resentment towards another, he allows himself to be influenced by that feeling, causing improper acts such as offending, humiliating, physically hurting. and verbally until they commit a murder without assuming the consequences of these.

WHAT ARE HUMAN LABOR RIGHTS?

According to Reynoso, C. Today, human rights are a concept that tries to reflect itself in the different spaces of societies and go from an abstract idea to trying to materialize in people's daily lives. (2017). It is very true that we have human rights as something vague because for most of society it is not something that causes relevance, therefore it causes that these are not fully known. For Badilla, A. et al, the right to work is without a doubt the most important right in the logic of consolidating a Social and Democratic State of Law. Personally, I consider that the right to work is one of the most important, since many other things depend on it, such as improving personal and family income.

In the same way, there are state, national and international organizations and institutions in charge of labor human rights, which are important because they provide information, moral and legal support to workers in any field. The ILO (International Labor Organization) is considered one of the most important organizations for the defense of labor rights, promoting equality and non-discrimination, which are important because they make a healthy and pleasant work environment.

In my opinion, today there are still many cases of discrimination in companies and institutions where they refuse to hire a person, where there are humiliations, threats, exploitation and even belittle the work done and any other form of violence due to discrimination due to reasons of gender, classism and racism with the workers.

According to the CNDH (National Commission of Human Rights), decent or decent work is understood as that in which the human dignity of the worker is fully respected; There is no discrimination based on ethnic or national origin, gender, age, disability, social condition, health conditions, religion, immigration status, opinions, sexual preferences or marital status. (2017). In my opinion, decent or decent work is one that does not lack respect for you and your rights.

MORAL RISK IN HUMAN LABOR RIGHTS

We can ask ourselves, what relationship exists between moral hazard and human rights at work?

Human labor rights, unlike other rights, are carried out exclusively to defend the interests of workers, being something that by law corresponds to each of them when they are part of an organization. One of the factors that can violate these labor rights is the moral hazard of senior managers as well as of their colleagues. It is vitally important to know labor human rights for your own benefit and that of the company or institution, since it facilitates your purposes to achieve your goals, among others.

Most of the time, people do not measure the severity that our actions can cause, in this way we could be talking about moral hazard as an individual. This can occur in the workplace and I manage to cause not very pleasant consequences. These consequences can range from a wake-up call, a layoff and even something more serious like an emotional and psychological problem.

Suppose that we are those who, at our moral risk, discriminate against a person at work, we know that this can probably affect the person emotionally and psychologically, although sometimes we doubt that the person is affected, as we believe it is just a "game", a game that could affect to a critical point because it causes low self-esteem, frustration, demotivation when doing a job, communication difficulties, among others. In the end it affects not only that person but also ourselves with legal problems. As aggressors we would justify our actions and words saying "It was a joke", "I did not do it with malicious intent", "I did not think it could affect you so much". As mentioned in occupational risk, we can commit acts consciously and unconsciously,And since we know that the person does not know their labor rights, we take advantage of the situation and in the end, we deny everything.

It is necessary to know the institutions and organizations such as the CEDH (State Commission on Human Rights of the State of Chiapas), the (CNDH) National Commission on Human Rights and the (IACHR) Inter-American Commission on Human Rights, which promote, protect and defend the rights human, including labor.

CONCLUSIONS

It is important to bear in mind that the moral risk in labor human rights affects us all, as much as the person who commits or carries out inappropriate and irresponsible acts as the person who receives them. Therefore we must take care that the things we think, say, feel and do must be consistent, so as not to make any mistake that may affect us and our environment. In the event that our actions are not the best, the correct thing is to assume the consequences responsibly and sensibly.
