Dissolution factors of the marriage bond in heterosexual couples in 2018 mexico

Anonim

The present work shows us the main factors that have led to the increase today, regarding the dissolution of the marriage bond in heterosexual couples, highlighting the psychological and socioeconomic factors, according to reports given by the National Institute of Statistics and Geography INEGI, Today divorces, both voluntary, uncaused or without expression of cause, as well as voluntary, have increased by 32% compared to 2010, with a higher incidence according to age, which is the female sex that most attends to the dissolution of the marriage bond.. These figures are really alarming, since, as there is a breakdown in marriage, it leads to family instability as the main purpose of marriage, mainly in children.

INTRODUCTION

Since the creation of man, there has been a biological need to have a partner and form sentimental and family ties, however, in this relationship there was no support or legal scope. In the year 1870, the figure of marriage arose legally, defining it "as the legitimate society of one man and one woman, who unite with an indissoluble bond to perpetuate the species and help each other carry the weight of life", as we can deducing this concept establishes the word "indissoluble" it was interpreted that only the death of one of the spouses could interrupt said marriage, the main purpose of marriage being the procreation of the family, the promotion of values and good customs.

Currently the concept of marriage establishes the Civil Code for the State of Veracruz in its article 75 "Marriage is the union of a single man and a single woman who live together to realize the essential purposes of the family as a social and civil institution" Within this union there are mainly mutual ends; respect, coexistence, equality, the possibility of procreating children in a free, responsible and informed manner. The family is derived from this link, recognizing it in its various types, since it is the fundamental nucleus of society which will guarantee conditions that fully favor the achievement of its goals. These will be constituted by legal or factual ties and will be based on the equal rights and opportunities of their members.

Over the years and with the evolution of Mexican laws and regulations, the concept of marriage was modified and the causes with which said union could be legally dissolved were emerging. In 1914 Don Venustiano Carranza, during his mandate, decreed that said marriage bond could be dissolved, and that is when the figure of divorce arises, that is to say, no longer an "indissoluble bond", if it did not become a "dissoluble bond", from from that moment is when couples begin to have the opportunity to end that union that was no longer satisfactory to them, emerging various ways of carrying out said dissolution.

DEVELOPING

The legislative body has carried out legal reforms as to how to end this marriage bond and have expanded the formalities to be able to do so, establishing today in the Civil Code for the State of Veracruz in its article 140 “Divorce dissolves the bond of marriage and leaves the spouses in a capacity to contract another ".

There are several ways to get a divorce:

  • Administrative: Before the person in charge of the Public Registry, as long as the requirements are met.Judicial: It is processed before the Judge according to the circumstances and compliance with the legal provisions.

Statistical data reveals that marriages have been declining every day, that is, couples no longer want to marry, since they prefer not to have a legal commitment that regulates them, on the contrary, divorces have been on the rise, INEGI reported that in in 2010 the number of registered marriages was 567,943 and in 2018 that number decreased to 526,008, and conversely the divorces from 86,042 that occurred in 2010 rose to 147,581. These figures are worrying, since the hierarchical figure of marriage has lost its essence and credibility. It is there where the concept and commitment of marriage begins to vary, various factors such as; psychological, social, economic, political, labor, health, coexistence, legal, etc., have led to the marriage bond, that which at one time was indestructible, today is increasing in an excessive way, leading to family instability, mainly psychological damage to children.

According to scientific data within psychological factors we can mainly find:

  • Age education and religion family history of divorce neurosis and infidelity violence

As well as within the socioeconomic factors, the main ones are:

  • Lack of communication Lack of employment. Excessive time at work Vices

conclusion

As I could dismember from this research, marriage must have as its fundamental base the preservation of values, coexistence, strengthening, equality and stability of the family. Heterosexual marriage, being the union of a single man with a single woman, entails mutual commitments and responsibilities, however, the conditions and various factors have led to the loss of the importance of these bases, for couples it is easier to resort to divorce, since that both the psychological and socioeconomic roles of the environment have led to seeing divorce as something more practical and recurring.

Within and after the divorce process, emotional and social changes fluctuate in family members, mainly in children. Although each person directly or indirectly has different perspectives and different ways of facing the dissolution of the marriage bond.

It is the responsibility of the parents to achieve an environment of harmony, peace and tranquility for the children, even when they are already divorced.
