Creation of a public entity for the sustainable development of a region of Nicaragua

In the context of this document, an approach is made for the technical-administrative implementation of the "Departmental Technical Secretary (Unit) of Rivas", under the framework of: 1. The Reinforced Strategy for Economic Growth and Poverty Reduction (ERCERP); 2. The National Development Strategy; and 3. The National Coordination System for the Participatory Implementation, Monitoring and Evaluation of the ERCERP.

Based on the final proposal for the "National Coordination System for the Implementation, Monitoring and Participatory Evaluation of the ERCERP" (PASE System), regarding the assembly of "Institutional Architecture" at the subnational level, we observe a dissimilarity between the offer presented to the Government Secretary, with the conceptual and operational proposal of the PASE System. Therefore, it is considered convenient to return to the original proposal for the implementation of the "Departmental Technical Secretary (Unit)" and the "Territorial Unit for Public Investment" (UTD and UTIP respectively), proposing for this purpose a model that under the particularities of the Rivas Department, would guarantee the short, medium and long-term sustainability of the institutional architecture at the departmental level.

It should be noted that the proposal contained in this document is taken within its conceptual framework of the PASE System, with some additions in accordance with the particular situation of the Department, thereby strengthening the institutional architecture from the beginning of the process, parallel to the formulation process of the Strategic Departmental Development Plan.

  1. Document objectives

2.1 General objective

  • Consolidate the implementation process of the "Departmental Technical Unit" (UTD) and "Territorial Unit for Public Investment" (UTIP), in the Department of Rivas, within the conceptual and operational framework proposed by the PASE System.

2.2 Specific objectives

  • Strengthen the implementation proposal of the UTD and UTIP, according to the particular characteristics in the department of Rivas;
  • Propose the "Institutional Architecture" of the UTD, with the requirements of the Human Resource necessary for its operation, in compliance with the roles and responsibilities proposed to be developed;
  • Present the terms of reference of the key positions that will make up the "Technical Secretariat of the UTD" and "Technical Coordinator of the UTIP"
  1. Conceptual considerations originating from the National Coordination System for the Implementation, Monitoring and Participatory Evaluation of the ERCERP (PASE System) and Base Documents

As a starting point and in accordance with the efforts made by the Secretary for Coordination and Strategies of the Presidency (SECEP), the proposal for the implementation of the Departmental Technical Unit is born from the conceptual and operational framework proposed by SECEP in the final document of the “National Coordination System for the Participatory Implementation and Evaluation of the ERCERP”, known as the “PASE System”, in its version dated May 29, 2003.

In the System Structure proposal, the existence of three axes is indicated:

  1. Political-Administrative Axis: made up of the different institutions, directly involved in the operation of the System, from the national to the municipal space. The entities at the national level are: in close coordination with the Presidency of the Republic, the Monitoring Committee, the Secretariat for Coordination and Strategies of the Presidency, SECEP. At the intermediate level, the Departmental Technical Secretaries with the Departmental Cabinets; in the municipalities the Municipal Governments and the County Authorities. For the Autonomous Regions, the instances in the same territorial order are: Presidency of the Republic; SECEP, Council and Regional Coordination, Municipal Governments and Community Authorities. (SECEP, 2003) Technical-Executive Axis:conformed by the technical and executive instances that guarantee the operation of the system. The fundamental entities are: the Technical-Administrative Unit at the central level; the Departmental Technical Units in support of the Departmental Technical Secretariats at the intermediate level, and the Municipal Technical Units, in the municipalities. (SECEP, 2003) Axis of concertation and Participation:They constitute the System made up of the coordination bodies that already exist or that are in the process of formation: CONPES in the national space; Departmental Development Councils, in the departments; COPLAR, in the autonomous regions of the Atlantic and Municipal Development Committees in the municipalities. For some specific actions (Social Audit), the participatory base structures are also considered: District Committees and the organizational expressions of the ethnic communities of the Atlantic: the Communal Committees.

The Departmental Technical Unit has the duality of articulating territorially (department or region) two of the axes proposed by the PASE System: 1. The Political-Administrative Axis and 2. The Executive Technical Axis. Hence the premise that it is necessary to have an STD, with specific functions that allow achieving articulation between the aforementioned axes. The role of the Departmental Technical Coordinator (Secretary) has a technical / political role, driving the process of the implementation of the Institutional Architecture at the Departmental and Regional level, as well as the Strategic Planning process.

An important role for the STD to highlight is to serve as a link (bridge) between the municipal and central levels, articulating geopolitical, technical-administrative and public investment actions.

The Institutional Architecture (structure), could strengthen, consolidate and streamline the process of creating the Departmental level and is in fact taken from the proposal presented in the results of the consultation of Arch. Edgar Sotomayor on the formation of the UTIP`s, the first version of the PASE System presented by consultants Myrna Moncada and Arch. Edgar Sotomayor dated December 2002 and the final version of the PASE System presented in May 2003.

The PASE System document presents the following general conformation of the STD, UTD and UTIP, at the departmental planning level:

  1. Departmental and Regional Technical Secretariats (STD and STR)

They constitute the intermediate coordinating instances and the main sphere of incidence of the System. Its constitution will vary according to the characteristics of the department, in some of them the coordination functions will be carried out by the Secretaries of the Presidency, even in functions, in others they may be prominent members of the departmental cabinets, UTIP coordinators or selected from relevant elements of civil society, chosen for the position. For the exercise of their functions they will have the support of the UTDs and will be administratively and methodologically supported by the SECEP on whom they will depend. They will be responsible for promoting the coordination of the Departmental Cabinet, facilitating and arranging the actions of the Departmental Development Council and following up on the actions of the UTD.

In coordination with the CDD and the UTD, they will administer the preinvestment fund directed to the municipalities, the support to the CDD and other funds that are transferred to the territory within the framework of the execution of the PASE.

  1. Departmental and Regional Technical Units (UTD / UTR)

In support of the Departmental Technical Secretariats, the Departmental Technical Units will be established, basically consisting of the Territorial Units for Public Investment (UTIP) of the SNIP and the Monitoring and Evaluation Units (UM&E) of the SINASIP.

The functions of these instances will be: to enhance and strengthen the capacities of the territorial actors for the formulation of the Departmental and Regional Strategic Development Plans in conjunction with other territorial planning instances, especially the INIFOM. They will also be responsible for formulating and consulting the corresponding operational and financial plans; the design and implementation of the corresponding indicator systems; harmonize and prepare proposals for economic growth; facilitate the articulation of public investment with territorial demand; facilitate Social Auditing and its harmonization with institutional monitoring and evaluation; promote and systematize the actions of the Social Communication component; and promote the Departmental and Regional agreement,by supporting departmental and regional coordination entities.

They will also promote the development of municipal capacities with regard to public investment planning, pre-investment, monitoring and evaluation of investments, as well as elements of social communication. These tasks will be carried out in permanent coordination with the UTMs who will be provided with the necessary tools. They will also disseminate information on the progress of the Departmental Development Plans and will promote the exchange of experiences between departments, regions and municipalities. They will also handle any other relevant information for the departments and regions such as INEC data, inventories of territorial projects, geo-referenced systems, inventories of natural resources and others.

The Monitoring and Evaluation Units (UM&E) incorporated into the Departmental Technical Units, will be specialized SINASIP structures whose fundamental purpose will be to implement the territorial versions of the SINASIP indicators that allow monitoring and evaluating the "Departmental Development Plans", managing information in coordination with the "Municipal Technical Units" (UTM).

  1. Proposal for the implementation of the “Technical Unit of the Department of Rivas”

From all of the above, it is established that the main objective and premise of the proposal is not to operate a unit that is outside the general framework of the PASE System proposal.

Taking the "PASE System Flowchart" (Figure No. 1), the necessary modifications have been made to adapt to the structure, conformation and human resources proposal of the "Departmental Technical Unit".

The proposal is also due to the effort that the current "Rivas Government Secretary" is promoting, with the support of the German Technical Cooperation Agency (GTZ), for implementation in two planning scenarios:

  1. Scenario No. 1: "Indicative Planning", with short-term actions that allow the implementation of the UTD and UTIP at the departmental level, within the operational framework of the "PASE System". Scenario No. 2: "Strategic Planning", developed In its first phase, with the collaboration of the Southwest Project, proposing a vision for the future, in search of a participatory process that involves consensus actions at the national, departmental and municipal levels, in order to promote the "Sustainable Development" of the department.

In the implementation of the UTD of the department of Rivas, we start from the premise that it does not constitute another bureaucratic burden for government and society, so the minimum required personnel is presented below:

  1. Departmental Technical Secretary; Coordinator of the Technical Unit for Public Investment; Administrator of the UTD (Accountant); Secretaries of the UTD / UTIP (2) Driver / manager; Concierge; Vigilante.

It is also suggested to include a representative or delegate of SINASIP, which will be budgeted from the headquarters.

For the internal organization of the UTD, a manual will be produced in the medium term that allows effective and efficient operation, in accordance with government decentralization policies.

In parallel with a strategic vision for the future, he will coordinate the efforts of the UTD for the “Formulation of the Strategic Plan for Departmental Development” (PEDD), coordinating the actions that allow the medium-term implementation and strengthening of the Departmental Development Council (CDD).
