The Occupational Risk Prevention Management System can become an almost autonomous operating engine that allows any company to reach criteria of excellence in the elimination of risks and accidents, obtaining benefits by reducing costs, improving the climate job, job satisfaction, etc., and all with minimal investment.

The first step to implement the System is the analysis of the situation, this is the starting point and it is very decisive. The goal is to gain insight into who the business is, what it needs, and how it needs it. With this information, we will plan the construction of a system taking advantage of the efficient processes that the company is carrying out and we will elaborate those that are not being carried out in such a way that they perfectly adapt to its structure.

This process requires a formal commitment from everyone, but especially from the company's management, which is decisive in guiding and motivating the rest of the organization to comply with the requirements of the Law on Occupational Risk Prevention and other system agreements. This commitment is formalized in documentation in what is called Prevention Policy.

The action takes place once the occupational risk assessment has been carried out, the results will determine the measures to be taken, deadlines and those responsible for execution, etc.

Based on the results of the evaluation, prevention planning is carried out, establishing objectives and goals, ways to achieve them and thus determining the actions to be carried out and procedures to achieve them. As well as reviews, inspections, treatment of non-conformities, internal and external audits, etc.

4-IMPLEMENTATION OF SGPRL

An Occupational Risk Prevention Management System (SGPRL) is the part of the general management system of an organization, which defines the prevention policy and which includes the organizational structure, responsibilities, practices, procedures, processes and the resources to carry out said policy. The SGPRL is an instrument that helps the organization reach the level of preventive action that is proposed, having a mechanism to achieve continuous improvement.

In order to implement an SGPRL, companies have sufficient criteria and tools to implement it and they are the PRL legislation with its Royal Decrees, the reform of the regulatory framework of the PRL 2003, as well as general guidelines and guides for its implementation. Although it is mandatory to say that it does not indicate how to do it and its dispersed and disorderly contents lead to confusion, the reform of the regulatory framework in PRL establishes the legal obligation to implement a prevention plan, which is nothing other than a business management system prevention of occupational hazards and does indicate the contents of the plan.

This prevention plan / Prevention management system in its art. 16.1 states that “The prevention of occupational hazards must be integrated into the general management system of the company, both in all its activities and at all hierarchical levels thereof, through the implementation and application of a plan for the prevention of occupational risks, this occupational risk prevention plan must include the organizational structure, responsibilities, practical functions, procedures, processes and resources necessary to carry out risk prevention action in the company, in the terms that are regulated by law. establish ”.

This "plan" referred to in art. 16 of the Prevention Law is the “prevention management system”. In section 2 of the aforementioned article, reference is made to the essential instruments for managing and applying the plan (risk assessment and planning of preventive activity). Regarding the elements of the management plan / system, although they are named in the last paragraph of section 1 of art. 16, but we have to wait for a subsequent regulatory development to know them more in depth.

Therefore, and in line with the above, I will go through the elements for the Implementation of the Management System for the Prevention of Occupational Risks in a company. For this I have created a fictitious construction company given the incidence of accidents in the construction sector.

We will call the company, XYZ. SL that I will take as a reference in those sections of the Plan that require it and that at the same time serve as an illustrative model of the result obtained. This Prevention Plan, like any Management System, has a documentary support, which, depending on the size, activity or complexity of the company, can be more or less extensive and neat. I wanted to reflect a standard Plan, applicable to practically all companies, regardless of their size, to which nothing is left over, and, if anything, some specific procedure must be added depending on the activity of the company. It is a Plan that complies with the legal regulatory requirements and that, in addition, has all those elements that I have considered strictly necessary to achieve its final objective:continuous improvement of working conditions.

The documentation of the Prevention Plan is composed of a Manual (The Prevention Plan Manual), the Prevention Procedures, the Work instructions and the Records.

THE MANUAL.

Presentation.

The first thing I must say about the Manual is that its obligation is not included in the applicable legal regulations. However, as stated in the OHSAS prevention standard, and the ISO quality and environment standards, the Manual is the basic document of the prevention management system. This manual includes:

  1. a) the preventive policy of the company and the objectives pursued in this matter b) the organizational structure the responsibilities and functions of all the subjects involved, as well as the interrelationships between them the relation of work procedures, their elements and way of elaborating the relation of work instructions, their elements and way of elaboration The collection of formats that will serve as support to the records resulting from the application of the different procedures.

POLITICS

The occupational risk prevention policy is the set of principles or guidelines that will govern the way the company acts in the area of ​​occupational risk prevention. From these principles, the general and specific objectives that will mark the way forward to ensure that our company is, in terms of prevention, what we declare in the policy should then emerge.

The policy, in addition to appearing in the manual, will be reflected in a written document and disclosed to the entire organization (ANNEX I).

ORGANIZATIONAL STRUCTURE

The Prevention Law, in its articles 30 and 31, includes the different options that the employer has when determining the preventive organization in his organization. Thus, art. 30.1 says that, "in compliance with the duty of prevention of professional risks, the employer will designate one or more workers to take care of said activity, will constitute a prevention service or will arrange said service with a specialized entity outside the company." In the following sections of this article, as well as in the following, some basic notions of the operation of the three preventive organization options established by the Law are given. On the other hand, in Chapter III of the Prevention Services Regulations, these two articles are developed in detail.

In ANNEX II, in which I describe company XYZ. SL that I will use to design and implement the Prevention Plan, it has opted for the preventive modality of designated workers simultaneously with the concert of preventive activities with an external prevention service. Thus, the company has two designated workers, who are in charge of the preventive disciplines of occupational safety, ergonomics and applied psychosociology and industrial hygiene (except hygienic measurements).

Health Surveillance and Hygienic Measurements are in agreement with an External Prevention Service.

One of the designated workers, with the Higher Technician Degree with the three specialties, is exclusively dedicated to preventive activities. The second, Senior Security Technician, is one of the Surveyors of the Technical Office, dedicating half of his working day to preventive activities.

Annex II contains the functional organization chart of the company, and Annex III, the Organizational Structure of the company XYZ.SL, as well as the corresponding records.

RESPONSIBILITIES AND FUNCTIONS

This section is closely linked to the previous one, since the preventive organizational structure that we saw in it will determine, to a large extent, the responsibilities and functions of each member of the company. It should not be forgotten that I start from a concept of prevention characterized by the “integration of this in the general management system of the company.

ANNEX IV details the responsibilities and functions in the company's Prevention Plan.

PROCEDURES

The System Procedures are documents that describe in detail how certain functions described in the Manual are performed, assigning those responsible for their execution.

Each company can create and establish as many preventive procedures as it considers necessary, but I think that an excess of procedures damages the functioning of the system, making it too bureaucratic. For this reason, I wanted to propose in the implementation of the system of 12 procedures (the twelfth, in addition, specific for construction companies), since I think that, in general, they can be sufficient for almost any organization. In fact, my proposal is a basic model that can serve as a guide to create, with some adaptations, the procedures of the vast majority of companies. I am aware, however, that large companies, with complex production processes or high-risk activities, may require some additional procedure, but in no case do I think there should be many more.

It should be considered that the recipient of the procedure can be any worker. It is a mistake to believe that it is aimed exclusively at Prevention Technicians. Therefore, it has to be a simple document, with a clear wording.

On the cover, in addition to the name and / or logo of the company, the name of the document, its coding, edition or revision number and date will appear, as well as the signature of the people who have prepared and approved it. It should also be mentioned if it is a controlled or informative copy. It cannot be forgotten that the prevention management system must and can be integrated with the quality and / or environmental systems if required by the organization of the company.

Every procedure will include the following sections:

OBJECTIVE: It will tell us what the procedure is intended to achieve.

SCOPE: Indicates which activities, processes, and areas of the organization are going to be affected by it.

RESPONSIBILITIES: The positions or positions that are going to be involved in complying with the procedure are included in this section.

DEVELOPMENT: It is the basic body of the procedure, in which each of the steps that comprise it is described in detail and clearly.

REFERENCES: Here we will include a list of all the internal and external documents with which the procedure is related, such as Manual, other procedures, standards (OHSAS, ISO, etc.), laws, decrees, etc.

Each procedure will have its own formats, which appear at the end of each one as annexes. The formats will be designed in such a way as to simplify and reduce to the maximum the number of annotations to be carried out by users. These formats, when completed, will become the system records. Regarding the management of these records, I refer to the corresponding procedure, in which all the details on the matter are collected.

The Prevention Management System that I propose in this project has the following procedures:

WORK INSTRUCTIONS

Work instructions are documents of a lower rank than the procedures that describe and detail how certain activities that pose special risks to the safety and health of workers are carried out. In construction companies, they constitute an important element of the preventive system, since a large part of the activities carried out involve considerable risks. The structure of the instruction is much simpler than that of the procedure and is made up of:

OBJECTIVE: what activity is going to affect

DEVELOPMENT: detailed explanation of how to carry out the activity, with what means of protection and how to record the results, when appropriate.

Like procedures, some instructions will have their corresponding forms as annexes, which will become records when completed.

RECORDS

Records are the system formats once completed. These records will allow us to verify the effective fulfillment of the system requirements, as well as its adequacy and effectiveness.

Likewise, the records will allow us, after analysis, to make decisions to improve the system. For this reason, the management of these records and their archive is very important.

ANNEX I

  1. LABOR RISK PREVENTION POLICY

The Management of XYZ, SL, aware that the prevention of occupational risks is an inalienable right of workers, essential to promote continuous improvement of their health and safety; as well as its legal duty and the benefit for the company to guarantee effective and efficient prevention for all employees, it has decided, in common agreement with all its workers, to formally enunciate a series of fundamental principles and commitments, which constitute the policy of the company and serve as a basic pillar where the Occupational Risk Prevention Plan to be implemented is established. These principles and commitments, which follow the key aspects of business policy indicated by the legislation itself, are:

  • Prevention will constitute a process of continuous improvement or "permanent action to improve existing levels" (art. 14 of the Law on Prevention of Occupational Risks - LPRL). The preventive activity will be integrated into the set of activities and decisions of the company, both in technical processes, in the organization of work and in the conditions in which it is provided, as well as at all levels of the hierarchical line; which means that all of them will assume the obligation to include the prevention of occupational risks in any activity they carry out or order and in all the decisions they adopt (art. 1.1. of the Prevention Services Regulation - RSP). The company will define functions and responsibilities for prevention at all hierarchical levels of the company,that will be included within a Risk Prevention Plan that also includes the practices, procedures, processes and resources necessary to carry out preventive action integrated into the organization (Art. 2.1. of the RSP). Information will be guaranteed, training and participation of all workers in preventive activity, as a key element in the success of the implementation of the preventive policy (arts. 18 and 19 LPRL).

ANNEX II.

COMPANY DESCRIPTION

The fictitious company XYZ. SL that I have chosen to implement the Prevention Plan / Prevention Management System, is a medium-sized company with a staff of 60 workers and dedicated to the Promotion and Construction activity. I believe that, due to size and activity, the resulting plan can be perfectly adapted to adapt it to both smaller and larger companies.

It is a Promoter / Construction Company, with a fixed staff of 40 workers, the rest 20 more are hired for each specific work. It is an average construction company, dedicated to building, with an average of 2 or 3 works in permanent execution. It develops its activity in localities of the Community of Madrid and neighboring provinces, mainly promotions of single-family houses and apartment and residential buildings.

Certain tasks, such as electricity, plumbing, painting, tiling and flooring, he subcontracts with companies in the area, with whom he has been working for many years.

PREVENTIVE ORGANIZATION

Preventive management in the organization and the degree of compliance with the regulations refer to compliance with the regulations on the prevention of occupational risks by the company.

The reform of the Law on the prevention of occupational hazards through Law 54/2003 is the benchmark of mandatory compliance with the legislation on the prevention of occupational hazards.

And therefore of compliance with the implementation of a Prevention Plan / Occupational Risk Management System in the company.

However, the reality is that prevention is not usually integrated into companies, and in many of them it has been functioning as a watertight compartment in which social influences and demands only enter at the stroke of sanction.

This is not the case with our company, XYZ Company. SL and its General Director are aware of the obligation to comply with the legislation, have the will and the preventive culture necessary to face the preventive organization, aware of the benefits it will entail for the company

not only for complying with the Law, improvement of economic results, productivity, and improvement of workers' relations with the company.

Therefore, it will face the challenge of preventing occupational hazards in the company, integrating prevention into the company's production system.

Organizing the management, implementing it and ensuring compliance with the legislation on occupational risk prevention in addition to everything that arises from this Occupational Risk Prevention Management Manual.

ORGANIZATION OF PREVENTION

The organization of prevention in CONSTRUCCIONES XYZ. SL is based, first of all, on the clear and unequivocal definition of the preventive functions and responsibilities of the different hierarchical levels of the company, as we say in our preventive policy principles, we want the prevention of occupational risks to be "integrated into the whole of company policies, in such a way that managers, technicians, managers and workers assume the responsibilities they have in the matter.. ". That is to say, our conception of prevention wants to go beyond the ineffective traditional approach that is based only on security control, creating a parallel organization disconnected from the company as a whole and where preventive functions are only attributed to the technicians of prevention,to be based on the most current and effective prevention management approach.

We want to make an efficient and effective prevention, for which we are aware that the only way is for the CONSTRUCCIONES XYZ staff. SL realizes that prevention is everyone's business, and assumes the functions and responsibilities that correspond to it in this matter.

On the other hand, complying with the law also obliges us to act in this way, since art. 14.2. of the Law on Prevention of Occupational Risks, determines that "the employer will carry out the prevention of occupational hazards by integrating preventive activity in the company." Likewise, art. 16.1 of the same standard establishes that "the prevention of occupational hazards must be integrated into the company's management system." In this same sense, art. 2.1 of the Prevention Services Regulation (RSP) clearly states that "the company will define roles and responsibilities in prevention at all hierarchical levels of the company, which will be included within a Risk Prevention Plan that also includes practices, procedures,the processes and resources necessary to carry out preventive action integrated into the organization ”.

Now, although our intention is that the prevention of occupational risks in CONSTRUCCIONES XYZ. SL is integrated into the entire organization, it is evident that we need to have specific prevention services that are in charge of advising, coordinating and controlling all preventive actions, as well as compliance with those specific activities that need to have staff specialized. For this purpose, within the different options to which, depending on the provisions of art. 10 of RD 39/1997 (RSP), we can welcome, in

XYZ CONSTRUCTIONS. SL we have opted for a mixed modality, in which the preventive activities, both specific and advisory, related to Safety at Work, Industrial Hygiene and ergonomics and Applied Psychosociology will be carried out by two designated workers, of which One will be a senior technician in the three mentioned specialties and the other a senior technician in the Occupational Safety specialty; and the preventive activities that have to do with Health Surveillance, as well as the hygienic measurements that need to be carried out, will be carried out through an agreement with an External Prevention Service (SPA). Likewise, the role of coordination and control of all preventive actions will be developed by a Prevention Officer,who will be the designated worker with a Higher Technician degree in the three specialties. He will dedicate his entire working day to preventive work, while the other designated worker will do it part-time.

Annexes to this manual include registration models for consulting workers on the prevention modality to be implemented (mixed); for the appointment and acceptance of the Designated Workers and for the appointment of the Prevention Officer. Said registration forms, once completed, will be filed by the Prevention Officer in a specific file intended for this purpose, in which the certificates proving the training of the designated workers and the agreement with the third party prevention service will also be kept.

The management of CONSTRUCCIONES XYZ, SL, appealing to the principle of integration of occupational risk prevention in the general management system of the company, has wanted to define the responsibilities and functions in preventive matters of all members of the organization, as well as that they are assumed by them, aware that this integration is one of the bases on which our preventive system is based. In correspondence with this approach, we will now detail the aforementioned responsibilities and functions.

DIRECTORATE-GENERAL

The management is responsible for guaranteeing the health and safety of the workers under its charge, for which it must develop the preventive organization of the company, defining the functions and responsibilities corresponding to each hierarchical level so that the commitments acquired through of the development of the provisions of the Prevention Plan. In addition, it will specifically undertake the following actions:

RESPONSIBLE FOR THE DIFFERENT AREAS OR FUNCTIONAL UNITS

At CONSTRUCCIONES XYZ, SL we consider the Technical Director and the Administrative-Financial Director responsible for the functional units. They will be in charge of promoting, coordinating and controlling that all actions carried out in their area follow the guidelines established by the management on occupational risk prevention.

Next, we are going to list the functions common to both managers, having to assess, in its fair measure, the scope and consequences that they have for each, depending on the number of workers in their charge, as well as the risks to which they are exposed.. MIDDLE CONTROLS

We consider the following as middle managers: the Construction Managers, the Foremen, the Officers, the Architect in charge of the Technical Office and the Workshop and Maintenance Manager.

Workers are also part of the Prevention Management System, since they are the main recipients of its specifications. But workers are not only subject to rights in prevention, but are also bound by a series of responsibilities:

DESIGNATED WORKER

As I have been repeating on numerous occasions, throughout the development of this Project, the Designated Worker is a fundamental piece in the gear of our Occupational Risk Prevention Management System. Their functions are:

PREVENTION DELEGATES

The functions of the Prevention Delegates are those contained in Law 31/1995:

HEALTH AND SAFETY COMMITTEE

The Health and Safety Committee will meet at least once a quarter, as well as whenever requested by any of its representations.

It will be the Committee that will set its operating rules, and in particular with regard to the appointment of President, Secretary and other members, renewal of positions, periodic information to be provided, call for meetings, preparation of minutes, resolution of differences between the parties, annual report, etc.
