Reflections on intellectual property in Mexico

To understand intellectual property, we must first understand who it is addressed to and who are the authorities that accredit such functions. In our country there is a group of people with entrepreneurship intentions, from individuals with ideas of innovation, expansion of art, implementation of knowledge developed by generations, among others; reaching legal entities (group of people) with motivations to generate a company or industry, both tax parties endorsed by the implementation of unique distinctive, from a simple drawing that will be the image of their inventiveness to the very formulation of their work scheme or product in question. On the other hand we have the Mexican Institute of Intellectual Property (IMPI) at the national level and on the other hand we have the World Intellectual Property Organization (WIPO) at the international level, each one in turn will be in charge of acting under the framework of the law against anyone who breaks the law against plagiarism.

In the basic model of intellectual property, we find copyright and industrial property. With which it will be recurrent to see the separation between fiscal and moral persons in these two bases.

Understanding what an intellectual property is, the first step to take is to define the origin, creation process, correct documentation and tests of the same, in order to be able to base the accreditation of your intellectual property, from my perspective, this process is limited to Certain personal works, where it comes into great conflict is in the reproducibility of cultural works, from typical costumes of a defined region, to the acclaimed national dishes and urban works, since at no time is there a reproducibility law that protects artisans of such works, appreciating a clear exploitation by large production houses of international stature. How can you patent something that belongs to an entire nation? It is then that a term known as public domain content enters, which allows this material to be exploited by anyone without risk of legal action that ends in monumental losses of money in the best of cases.

It should not be forgotten that in Mexico there is a great problem with respecting the legal margin, with regard only to copyright, since piracy distributes the popular sector of the country, which is a majority, selling a diversity at low costs of works of different origins, international and national.

However, it also favors the competitiveness of the market, since in perspective, new ideas improve an already implemented scheme, from consumer service, to ideas that facilitate the comfort of users, significantly increases the profits from the concession of the rights to use intellectual property, a strategy used to distribute your product without being the one who manufactures it, thereby indirectly generating a trend in the market, promoting your product and setting perishable quality standards for the consumer, which will be a referendum for the purchase of similar products in the future.

Another equally important part is that with innovation and supporting evidence such as patents, financial gaps can be opened for investors from different countries and even nationals, which will indirectly favor the personal economy of the individual or individuals related to the project. It will support the country's economy since with the opening of an industrial plant or the opening of businesses it will generate jobs at various levels. It should not be forgotten that this type of action generates favorable collateral effects for commercialization, since it will begin to see the accreditation of international intellectual property, which generates a great export opportunity, thus growing the economy even more.

Intellectual property is not only about making an idea your own, but also that you can generate income from itIt is about protecting your ideas so that third parties do not profit from your creativity, it gives you the opportunity to become competitive in a progressive society, improving and never plagiarizing, since saturation has made innovation more difficult for what opportunists will seek a gap regardless of the consequences. This process is based solely on complying with the guidelines set by the institute and the organization depending on the level at which you want to accredit an idea, however it will always be based on having evidence of what you say you have developed, unfortunately in our country most of The investment is given by the foreign party to support ambitious projects, since as in most businesses, ideas will always be sold, entertainment is money along with knowledge. In my experience,"Ideas are the set of imagination, dreams and fears" we design not to stagnate, to meet emerging needs, not to perish over time and to have an income doing what we like the most.

Seeking to attribute an idea will define you in the market, where anyone can steal an idea if we are not careful to register it, fortunately there are authorities that defend ideas, "What will you do for your mind, if it has already discovered infinite energy?"
